Security deposit: To ensure the protection of our property and its contents, guests are required to provide a security deposit of US $500 1-days before the scheduled check-in date. This deposit must be submitted in full and will be refunded within 7 days after the check-out date, provided no damages or incidents have been reported. In the event of any damage to the property, its furnishings, or other contents during the stay, the cost of necessary repairs or replacements will be deducted from the security deposit. Any remaining balance will be promptly refunded to the guest. Guests are essential to report any damages or incidents promptly to enable accurate assessment and resolution. Failure to comply with this requirement may result in additional charges beyond the security deposit. By booking and staying at our property, guests agree to adhere to this security deposit policy.
Terms and Conditions
Welcome and thank you for booking our property. Please make sure to read this short-term rental agreement (the “AGREEMENT”) in its entirety. This is a tourist and recreational lodging agreement under the modality of short-term rentals, hereinafter referred to as the “CONTRACT,” which shall be governed in accordance with the laws of the Republic of Costa Rica and pursuant to the clauses specified below in the terms and conditions section. Additionally, the short-term rental property you have selected (“THE PROPERTY”) may have additional rules, policies, terms, and conditions that apply to your stay, which are listed on the website where you made your reservation or may be communicated via email, text message, or electronic messaging (WhatsApp, etc.). Your reservation is also subject to the terms and conditions of the website through which it was made.

II. TERMS AND CONDITIONS
If you proceed with the reservation (clicking the booking button and/or proceeding with payment via credit card), you acknowledge and accept each term included in this rental CONTRACT, specifically including each of the terms and conditions described above, as well as any rules, policies, terms, or conditions applicable to the specific property you reserved.
1. RESERVATION: This CONTRACT is between the “OWNER,” whose details and representation are indicated in the CONTRACT SUMMARY, and the person completing this reservation for the vacation rental property (“YOU” or “GUEST”). The OWNER provides the vacation rental PROPERTY subject to the terms of this CONTRACT. You agree that you will be present at the PROPERTY for the entire duration of the reservation and will be responsible for the actions and behavior of every person present at the PROPERTY during your stay. This includes ensuring that all members of your group or those present at the PROPERTY (each an “OCCUPANT”) are aware of and comply with the terms of this CONTRACT. If you bring a minor as an OCCUPANT, you acknowledge and agree that you are solely responsible for supervising that minor during your stay and accept the terms of this CONTRACT on behalf of each minor.
2. PAYMENT AND CANCELLATION TERMS: The total amount due, including fees, taxes, and other charges, is shown on the website used by the GUEST to book the property or provided in a prior written quote. A portion of the total payment may be due at checkout. The balance must be paid prior to arrival within the timeframe indicated on the booking website. Please review these amounts carefully. You may cancel your reservation at any time; however, all amounts paid prior to cancellation are non-refundable unless specifically stated otherwise at checkout. Review the specific cancellation and refund terms in the listing before paying, as no exceptions will be made once your reservation is confirmed.
3. HOUSE RULES AND POLICIES: The vacation rental has specific rules and policies regarding pets, smoking/vaping, quiet hours, parking, use of pools and/or hot tubs, and other local regulations. These rules are detailed on the PROPERTY listing page of the website where you booked and/or were sent in writing via electronic message. Please review them carefully, as violations may result in fines, additional charges, or immediate eviction of the GUEST and other members of your group from the PROPERTY without refund. Violations of any law or ordinance by any individual staying at the PROPERTY will also result in immediate eviction without refund.
4. ARRIVAL DETAILS AND CHECK-IN/CHECK-OUT: Once your reservation has been fully paid, you will receive instructions from the property manager (“RENTALQUEST”) on how to access the PROPERTY. Check-in and check-out times will be communicated prior to arrival unless otherwise stated in the listing. Please confirm your expected arrival time with RENTALQUEST. If you or any member of your group fails to vacate the PROPERTY at the designated check-out time, you authorize the OWNER and RENTALQUEST to charge the credit card used for booking for an additional night or request direct payment. They may also initiate necessary procedures to remove you, your occupants, or your belongings from the PROPERTY.
5. DAMAGES: Any damage to the PROPERTY must be reported to the OWNER or RENTALQUEST before check-out. YOU agree that any damage caused is your full responsibility. This may include damages or losses during your stay, violations of house rules, additional cleaning fees, fines, or other costs incurred due to your behavior or that of your occupants. You authorize the OWNER and RENTALQUEST to charge your credit card for such damages or request direct payment. To avoid charges for pre-existing damage, notify RENTALQUEST of any issues upon check-in.
6. ADDITIONAL FEES AND SERVICES: Mandatory and optional fees related to the reservation are specified on the booking website. If you use options that incur additional charges without reporting them (e.g., pet fees, pool heating), and it is later discovered, you authorize the OWNER and RENTALQUEST to charge your credit card or request direct payment.
7. MAXIMUM OCCUPANCY: The maximum number of occupants is specified in the listing and applies to overnight guests, daytime visitors, and children. Exceeding this limit without written approval may result in immediate eviction and forfeiture of all payments.
8. PARTIES AND LARGE GATHERINGS: Parties and large gatherings are NOT allowed under any circumstances. Unauthorized events may result in eviction without refund, and the OWNER or RENTALQUEST may contact local authorities if necessary. YOU agree to respect the PROPERTY, neighbors, and community, and to comply with all applicable laws and noise ordinances.
9. PROPERTY CONDITION: The OWNER strives to maintain the PROPERTY in excellent condition. If you notice any issues, hazards, or cleanliness concerns, notify RENTALQUEST immediately. If the PROPERTY is not as represented, compensation may be offered at the sole discretion of the OWNER or RENTALQUEST, but it will not exceed the amount paid. Shared amenities are not under the OWNER’s control.
10. CLEANLINESS: You are expected to treat the PROPERTY with respect, recognizing it is a private home, not a hotel room. Leave it clean and orderly and follow check-out instructions.
11. INDEMNIFICATION AND LIABILITY RELEASE: YOU agree to indemnify and hold harmless RENTALQUEST and the OWNER from any liability, claims, damages, injuries, costs, or expenses arising from your use or occupancy of the PROPERTY.
12. ASSUMPTION OF RISK: YOU and all occupants assume all risks associated with use of the PROPERTY, including pools, hot tubs, nearby water bodies, recreational equipment, and activities. You acknowledge risks of infectious diseases such as COVID-19 and accept full responsibility for participation in any activities.
13. LIMITATION OF LIABILITY: To the maximum extent permitted by law, the OWNER and RENTALQUEST shall not be liable for indirect, incidental, or consequential damages related to your stay.
14. FALSE BOOKINGS: Reservations made under false pretenses (e.g., false name, age, or group size) may be canceled immediately without refund.
15. SHORT-TERM RENTAL ONLY: This is a temporary vacation rental, not a long-term lease or residence. No tenancy rights are created. Extensions are subject to availability and additional charges. Subletting or assignment is not permitted.
16. JURISDICTION: This CONTRACT shall be governed by the laws of the Republic of Costa Rica.
17. GENERAL TERMS: If any provision is deemed invalid, the remaining provisions remain in effect. This agreement is binding upon the parties and their successors. YOU may not assign this CONTRACT. This CONTRACT complies with Costa Rican law without discrimination. It becomes binding upon receipt of your initial payment, which constitutes acceptance of all terms.
